INTERNATIONAL CONVENTIONS AND TREATIES

    International agreements, conventions and multilateral treaties have been assigned distinctive and recognizable short titles in the jurisdiction sections. Whenever possible, the listing is accompanied by a date that reflects the date of ratification or deposit of instrument of ratification or official declaration or announcement of adherence or extension of application. Treaties that have been signed but not ratified by a jurisdiction are not represented, the only exception being the United Nations convention on the law of the sea, in which instance signatories as well as ratificants are listed, with appropriate indications of status. Note that some conventions dealing with private international law as well as specific subject aspects of law may be listed in more than one subject division.
    Every effort has been made to provide citations to easily accessible or standard sources for the best English-language versions of these treaties and conventions. A list of sources for the treaties cited below follows this appendix. Certain treaty collections are so well known, with their standard citation universally recognized, that they have been excluded from this bibliographic arrangement. All other treaty collections or sources are given full bibliographic descriptions, including those works already fully described in the “List of materials indexed.”

TREATY SOURCES AND COLLECTIONS

African Economic Community treaty. Treaty establishing the African Economic Community, Organization of African Unity. Abuja, Nigeria, 3 Jun 1991. New York, Mansell, 1992. All African states, except Morocco, but including some of recent independence, such as Eritrea, are parties and 42 states have ratified the treaty. The Economic Community has its own legal personality, although it is also an integral part of the Organization of African Unity. The treaty, characterized by a broad range of economically oriented objectives in theory, can be likened to the European Union treaties. It aims to create or establish regional economic integration over a vast and disparate region, progressing in stages during a long transitional period of 40 years, with the ultimate accomplishment being an African Common Market. Organs were established or outlined at a meeting of foreign ministers or heads of state at Harare in 1997 and encompass creation of: 1. Assembly of Heads of State or Government; 2. Council of Ministers; 3. Pan African Parliament (to date, no further detailed structure or powers); 4 Economic and Social Commission; 5. General Secretariat; 6. Specialized Technical Committees; 7. Court of Justice.

African intellectual property agreement. African Intellectual Property Organization Agreement. Agreement relating to the creation of an African Intellectual Property Organization. Created by the Agreement of Bangui of 2 Mar 1977. The original Bangui agreement was replaced by a revised Convention of Bangui 24 February 1999, conforming to the TRIPS± requirement of the World Trade Organization. The annexes to the revised Bangui Agreement contain uniform laws governing all aspects of intellectual property in the African Member States, these should serve as new national laws with implementation required by membership in the African Intellectual Property Organization. Benelux intellectual property convention. Benelux convention on intellectual property. The Hague, 25 Feb 2005. In force 1 Sep 2006. Full text with explanatory notes at http://www.boip.int/. French text, with rules, at http://www.wipo.int/wipolex/. This is an entirely new convention governing designs and trademarks. Consolidates, replaces and repeals the Benelux designs convention of 1962. The 2005 rules conform to European Community directives and practices. Establishes the Benelux Intellectual Property Organization.

 

The Benelux constitutive treaty, signed at the Hague 31 Feb 1958, expires 31 Oct 2010. Article 99 stipulates a further extension of ten years if no party explicitly opposes such extension. Unique within the EU, Belgium, Luxembourg and the Netherlands were accorded authority for a more complete regional union and there has evolved the Benelux Economic Union with its own parliament, secretariat general, committee of ministers and court of justice. Within this environment, Benelux organs have flourished, although Community law always retains primacy over Benelux law. Federalization of the Belgian regions has brought about a further Benelux involvement and participation at the sub-national level. In a sense, as some aspects of Benelux fall away or atrophy or have been replaced by EU procedures, e.g., transformation cooperation, others have grown in recognition and importance, e.g., police and security cooperation, justice, etc. Its functions are moving towards those of a sub-regional grouping with an existence both within and outside the EU. A new Benelux treaty, revising the 1958 instrument was signed at the Hague 17 Jun 2008 and came into force in 2010. English translation in 40 Revue de droit international 561 (2007).

BRUSSELS, LUGANO and SAN SEBASTIAN JURISDICTION CONVENTIONS

Brussels convention (Parts I and II):

Brussels I. Convention on jurisdiction and the enforcement of judgments in civil and commercial matters. Brussels, 27 Sep 1968 and Protocol of 3 Jun 1971 (interpretation by the Court of Justice of the European Union in international execution against judgment debtors). This first European Union convention was amended in 1978 by the convention of 9 Oct 1978 (accession of the Kingdom of Denmark, the Republic of Ireland and the United Kingdom) and again 26 May 1989 (accession of the Kingdom of Spain and the Republic of Portugal). Further amended by the accession conventions of Austria, Finland and Sweden. The original and various amended texts reprinted in 8 International legal materials 229 (1969) and 18 International legal materials 8 (1979) and in Official journal (EU) 1978 L304/1, C189/2 and 1998 C271/1. These formats and other reprints are primarily of historical interest only. To add to the confusion, the controlling text of Brussels I is a 1989 version known as the Convention on jurisprudence and judgments, San Sebastian, 26 May 1989 in Official journal (EU) 1989 L285/1 (this was actually the Accession convention of Spain and Portugal to the Brussels convention). The designation of San Sebastian is no longer important and we revert to the simple Brussels convention. On 22 Dec 2000 the Council of the European Union adopted the 1968 convention as amended as Council regulation 44/2000 in Official journal (EU) 2001 L12/1. As of 1 Mar 2002 this regulation replaced the 1968 Brussels convention; however, we feel it may be historically significant to maintain the designation Brussels convention (Brussels I) since the convention has been adopted as a regulation and so it is no longer subject to the amendatory processes as the new states join the Union in May 2004, it is important to note that while the Brussels I Convention has been ratified by all 15 Member States of the Union as presently constituted, and so is in force for all Member States, the provisions of the subsequent Council regulation of 2000 do not apply to Denmark. The researcher would now, at least for current use, only seek the texts of the regulation of 2000 either in an official publication or online via Eurolex at http://www.europa.eu.int/ or Lex Mercutoria at http://www.jus.uio.no/lm/.


Brussels II. Convention on jurisdiction and the enforcement of judgments in matrimonial matters and matters of joint responsibility for children. Brussels, 28 May 1998 in Official journal (EU) 1998 C221/1. This convention, known as Brussels II, has various earlier texts that need not concern us. It was adopted by the Council of the European Union on 29 May 2000 as Council regulation 1347/2000 in Official journal (EU) 2000 L160/19. It also will not be subject to accession amendments, although a new Brussels II convention was proposed in 2004. As of 2007, it has not been adopted by the Commission, nor has it yet been made subject to a ratification process.
    The effects and status of the Brussels conventions, especially Brussels I, have been complicated by a further convention representing an extension of the Brussels convention (I) to Member States of the European Free Trade Area:

Lugano jurisdiction and judgments convention. Convention on jurisdiction and enforcement of judgments in civil and commercial matters. Lugano, 11 Sept 1988 in Official journal (EU) 1988 L319/9. 28 International legal materials 620 (1989). The Lugano convention is in force among the fifteen Member States as of Jan 2004 and the remnants of EFTA (Iceland, Norway and Switzerland). The Court of Justice of the European Union has the authority to interpret Brussels I and II, but it has no authority over the Lugano convention.
 
    A great deal of exegetical material about these conventions has and will continue to appeal to researchers although earlier works are of primarily historical value only. Even here we can recommend The Lugano and San Sebastian conventions. Edited by M. Carpentev [et al.], London, Butterworths, 1990 and, with the Explanatory report and annexes, in Lugano convention: convention on jurisdiction and the enforcement of judgments in civil and commercial matters. In the Spring of 1998 the Commission issued a communication to the Council and the European Parliament, “Towards greater efficiency in obtaining and enforcing judgments in the European Union” in Official journal (EU) 1998 C33/3. More and more the question of jurisdiction and the enforcement of judgments turns on decisions of national courts of the Member States. Much of this jurisprudence is not easily accessible and some is not even officially reported. Two works can be recommended as research aids. European caselaw on the judgments convention. P. Kaye, Chichester, John Wiley, 1998 is a compilation of abstracts of relevant decisions arranged by country and by articles of the treaty with useful tables. The same author’s more ambitious Law of the European judgments convention. P. Kaye. Chichester, Barry Rose, 1999. 5 vols., while rather dismaying at first glance is a well-organized treatise providing valuable analysis and case law commentaries article-by-article on the Brussels I convention and those sections of the Lugano convention superseding it, with attention to the variations and changes introduced by Lugano. Full texts of the conventions, with various accession modifications, as of 1999, are also set out. The work missed the adoption of the 2000 regulation. CARIBBEAN COMMUNITY AGREEMENTS and TREATY

Caribbean Community (CARICOM) Caribbean Court of Justice. The Agreement establishing the Caribbean Court of Justice. St. Michaels, Barbados, 14 Feb 2001. In force Jul 2002. Although in force, the agreement awaits implementing legislation by each state, after which the Court will be the Final Court of Appeal for Caribbean Commonwealth States, replacing the Judicial Committee of the Privy Council.

Central American Free Trade Association. The Central American Free Trade Association exists as the creation of the General Treaty on Central American Integration, Managua, 13 Dec 1960. Entirely reformed by the Protocol of Guatemala City, 29 Oct 1993 signed  and ratified by Costa Rica, El Salvador, Guatemala, Honduras and  Nicaragua and by the amendment signed at Managua 27 Feb 2002. The amendment acceded to by Belize and Panama, 12 Mar 2002. The Association functions within the Sistema de Integracion Centroamericana (SICA) created by the Protocol of Tegucigalpa, 13 Dec 1991. The Association has so far negotiated separate free trade agreements as a bloc with Chile, The Dominican Republic and Panama. There is a pending treaty awaiting ratification with the United States. CMEA arbitration convention. Convention on settlement by arbitration of civil law disputes resulting from economic, scientific and technical cooperation. Note: The current status of COMECON treaties remains unclear. Due to the nature of the instruments, all countries concerned (that were formally bound by the treaties) must terminate by depositing a notice of termination with the Secretariat (a part of the now-defunct government of the U.S.S.R.). Even this requirement would not apply to states which never were formally bound, e.g., the Baltic states. It is likely this situation will have to be corrected by legislation. The Código Bustamente is essentially the product of the Cuban international law scholar, Antonio Sanchez de Bustamente y Sirven who presented his “Código de derecho internacional privado” at the first Congreso Sud-americano de Derecho Internacional Privado held in Montevideo in 1888 and 1889. For many years it languished as a “draft code” until finally adopted for the American states in 1928. In actual practice it seems to lie somewhere between an international convention and a model code or uniform act. Many of the states that have adopted and ratified it as the guiding source regulating their private international law (on a reciprocal basis) have enacted it as a piece of municipal legislation with various modifications and qualifications rather than a treaty.

The second revision was concluded 19 Mar 2010 and should enter into force by 2013; the basic Agreement is scheduled to remain in effect until 29 Feb 2020.

    The Cotonou agreement has moved slowly through the ratification process, which has, to all intents and purposes, was completed with Belgium’s ratification of 17 Jan 2003 and the European Union’s ratification of 22 Feb 2003, and the adherence of the new E.U. states on 1 May 2004 and 1 Jan 2007, and the ratification by all, or nearly all, ACP states. The Cotonou agreement entered into force 1 Apr 2003. On 23 Jun 2006 a revised text of the Cotonou partnership agreement (CPAII) was signed at Luxembourg by the Member States of the Enlarged European Union and the ACP states. As of 2007 it has received ratification by all the Member States of the European Union and has received the required ratifications (67% of approximately 79 former colonial states, although a few states have not ratified it) and is in force. This supersedes the first Cotonou agreement of 2000 and, in general, will be more compatible with the free trade principles of the WTO± and TRIPS.±

    The existence and effect of these series of economic and trade agreements between the European Union and its Member States and the 77 ACP states has now been challenged by the WTO, which has declared that the Cotonou agreement, or the trade supports and the effects of the agreement are contrary to WTO rules. The European Union finds that these various preferential programs giving access to the European markets for agricultural products and some raw materials from the former colonies of Britain, France, Belgium, The Netherlands, Spain, Portugal and Italy was supposed to be renegotiated to meet the WTO’s deadline of 1 Jan 2008. Representative regional groups and organizations from the ACP countries (African, Asian-Pacific and Caribbean-Pacific) have commenced direct negotiations with the European Union to develop new Economic Partnership Agreements on a reciprocal basis that would not violate WTO rules. This date had already existed as a goal for massive renegotiations, but the WTO position has given new impetus and urgency to phasing out the Cotonou agreement and replacing its mandates with something more acceptable to the free trade position of the WTO.

    The European Economic and Social Committee has been in charge of renegotiations since 2 Oct 2003 when the Joint declaration of the ACP-EC ministerial level meeting on Negotiations of Economic Partnership Agreements (EPA) was issued. The EU has used different regional organizations as the vehicle for obtaining agreement to the new EPA’s. This concluded the first round of negotiations that commenced in September 2002. EUROPEAN CONVENTIONS—Council of Europe

The Council of Europe has directed the negotiation and ratification of nearly 200 multilateral instruments generally, but not consistently, titled “European...convention.” These were concluded and published between 1949 and 2003 as European treaty series nos. 0–193. Although the numbering has continued in sequence, commencing in 2004 the nomenclature has changed to “Council of Europe convention....” We retain the original designation for nos. 1–193, and now follow the new nomenclature for nos. 194 and following, even though the Council has now re-titled or re-abbreviated the entire series as CETS, rather than ETS. When a convention, of whatever date, had neither “European” nor “Council of Europe” as a prefatory identification, we have arbitrarily inserted “Council of Europe.” Full texts of all conventions in English, French, German, Italian and Russian, along with current status, reservations, etc., can be accessed on the Council’s website at http://conventions.coe.int/. Montreal convention. Convention for the unification of certain rules for international carriage by air. Montreal, 10–28 May 1999. Reprinted in 24 Air and space law 142 (1999) and 1999 Aviation quarterly 118. This convention, signed by 52 states at Montreal, is designed to replace the 1929 Warsaw convention. The Montreal convention came into force on 28 Jun 2004 with the ratification by the French Republic. It creates a two-tiered regime for death or injury to passengers (unlimited) and destruction or loss of baggage (higher than Warsaw). The 1999 convention is a consolidation, incorporating the text of the Warsaw convention of 1929 as amended by the Hague protocol of 1995, the Guadalajara convention of 1961 (“Supplementary to the Warsaw convention”), the Guatemala City protocol and the Montreal protocols 1–4, and the International Air Transport Association (IATA) intercarrier agreements of 1995–1996. The Montreal convention came into force on 28 Jun 2004 with the ratification by the French Republic. It Montreal convention replaces the Warsaw convention (whether or not the ratificant states denounce the Warsaw convention); however, if a state has ratified the Warsaw convention, but not the Montreal convention, then the Warsaw convention remains in force for that state. The Warsaw convention was ratified by 151 parties and entered into force 13 Feb 1933. A separate protocol modifying the Warsaw convention was signed at The Hague 28 Sep 1955 and has been ratified by 136 parties and entered into force 1 Aug 1963. This has also been absorbed by the Montreal convention.

Not in force and not likely to come into force. 177 states signed the treaty and it has been ratified by 137 states; however, 44 states are listed in Annex II of the treaty as being state parties whose ratification is required before the treaty can come into force. Among the Annex II countries that have not yet(!) ratified the treaty are China, Democratic Peoples Republic of Korea, Egypt, India, Iran, Israel, Pakistan and the United States. United Nations convention on the rights of persons with disabilities. The Convention on the rights of persons with disabilities and its optional protocol was adopted on 13 Dec 2006 at the United Nations Headquarters in New York, and was opened for signature on 30 Mar 2007. There were 82 signatories to the Convention, 44 signatories to the optional protocol, and one ratification of the Convention. This was the highest number of signatories in history to a U.N. convention on its opening day. It is the first comprehensive human rights treaty of the 21st century and is the first human rights convention to be open for signature by regional integration organizations. The Convention entered into force on 3 May 2008.

Yaoundé conventions. Yaoundé convention (First), Yaoundé, Cameroon, 20 Jul 1963. Agreement between the European Community and the former European colonies in Africa (18 states and the European Community). In effect 1964–1969. Yaoundé convention (Second), Yaoundé, Cameroon 29 Jul 1969. Agreement between the European Community and the former European colonies in Africa, expanded to include Mauritius and Madagascar. In effect 1971–1975. The Treaty of Rome, 1957 had granted “associated status” to the then-31 “overseas collectivities and territories” formerly administered or connected to the Member States of the European Community as of 1957. The two Yaoundé conventions, precursors to the Lomé conventions, represented the first international agreements constructed to represent exclusively the economic and trade interests of the former colonial African states (mainly French as of 1957). The Secretariat created by the Georgetown Agreement between the European Community and the then-46 ACP states at Georgetown, Guyana 6 Jun 1975, in effect 12 Feb 1976. This agreement, creating a separate organizational and administrative structure for the now-77 ACP states, was revised in 1992 and again revised and formalized at Brussels, 28 Nov 2003. The accession of the United Kingdom to the Treaty of Rome in 1973, bringing with it numerous former colonies or mandates in Africa, the Caribbean or the Pacific, mandated an entirely new approach to trade and aid relationships between the European Community and their former colonies. This resulted in the series of Lomé conventions beginning in 1975.
